The most common fraud offence is contained in section 192E of the Crimes Act

According to section 192E, a person who, by deception, 

  • dishonestly obtains property, or 
  • dishonestly obtains financial advantage or 
  • dishonestly causes financial disadvantage  

is guilty of an offence. 

The definition of ‘dishonest’ can be found in section 4B of the Act, which states: 

‘dishonest means dishonest according to the standards of ordinary people and known by the defendant to be dishonest according to the standards of ordinary people’.
